9.1 The Supplier shall not be held liable for disruptions due to force majeure or unforeseeable circumstances, such as accidents, theft, fires, explosions, strikes, earthquakes, floods or similar events which fully or partially prevent the order from being executed in the time and manner agreed.

9.2 Except in the case of wilful misconduct and gross negligence, the Supplier shall not be held liable for disruptions resulting from the use of the internet beyond its control.

9.3 Should the agreement not be performed for reasons not attributable to the Supplier, the Purchaser shall retain all rights provided for by law and these general conditions.

9.4 The Supplier shall not be held liable for any fraudulent use of payment methods by third parties, provided that the Supplier proves that it has taken all possible precautions in accordance with due diligence.

ART. 10 – CONSUMER’S RIGHT OF WITHDRAWAL

10.1 Right and time limit. The Consumer shall have the right to withdraw from the agreement without having to provide any reason and without incurring additional costs than those specified under Articles 10.7 and 10.8 below, within 14 (fourteen) days.

10.2 Start of withdrawal period. The withdrawal period starts:

  • a) from the day the Consumer or an appointed third party, other than the carrier, acquires physical possession of the goods;
  • b) from the last good, in the case of multiple goods ordered in a single order and delivered separately;
  • c) from the last batch or piece, in the case of goods consisting of multiple batches or pieces.

10.3 How to exercise the right of withdrawal. Prior to expiry of the withdrawal period, the Consumer shall inform the Supplier of their decision to withdraw from the agreement. For this purpose, the Consumer may:

  • a) use the online withdrawal function available on the www.servettocose.com website, which is easy to access and bears the wording “Right of withdrawal and returns procedure”. Following online submission, the Supplier shall promptly send an acknowledgement of receipt on a durable medium (email);
  • b) use the standard withdrawal form (Annex A) and send it to Servetto S.r.l., Via Brughetti n. 32, 20813 Bovisio Masciago (MB) or via Certified email to servetto@pec.it or by email to info@servettocose.com;
  • c) send any other explicit statement of withdrawal to the same contact details.

The right of withdrawal shall be deemed to have been validly exercised if the notice of withdrawal is sent before the expiry of the withdrawal period.

10.4 Failure to provide information. If the Supplier has failed to provide the information on the right of withdrawal required under Article 49, para. 1, letter h) of the Consumer Code, the withdrawal period shall expire 12 (twelve) months after the end of the initial withdrawal period. Should the Supplier provide such information within that period, the withdrawal period shall expire 14 (fourteen) days after receipt thereof.

10.5 Refund. In the event of withdrawal, the Supplier shall refund all payments received from the Purchaser-Consumer, including standard delivery costs, without undue delay and within 14 (fourteen) days from the date of notice of withdrawal, using the same payment method, unless agreed otherwise and provided that the Consumer incurs no costs. The Supplier may withhold the refund until it has received the goods or until proof is given that they have been shipped.

10.6 Return of goods. The Consumer shall return the goods without undue delay and within 14 (fourteen) days from the date of notice of withdrawal. The deadline is met if the goods are shipped before the period expires. Returns may be made via: a) delivery directly to the premises of Servetto S.r.l., Via Brughetti n. 32, 20813 Bovisio Masciago (MB), after arranging a day and time with the Supplier; b) shipping by courier or postal service to the address specified above, at the Purchaser-Consumer’s expense. The Purchaser-Consumer is required to return the products in the following conditions: intact in their original packaging where possible (boxes, protective materials and any accessories included in the package); and accompanied by all accessories, manuals and documents included in the original package. We recommend using suitable packaging for shipping and keeping the shipping receipt as proof of return. No specific shipping method is required; however, the Purchaser-Consumer is liable for any loss of or damage to the goods during return transit, unless such damage is attributable to defects in the original packaging.

The Consumer may handle the goods solely to the extent necessary to establish their nature, characteristics and functioning. The lack of original packaging shall not, in itself, result in the forfeiture of the right of withdrawal, without prejudice to the provisions of Article 10.8 below regarding any diminished value of the goods.

10.7 Return costs. The direct costs for returning the goods are charged to the Consumer, as specified in the pre-contractual information.

10.8 Liability for diminished value. The Consumer is liable for any diminished value of the goods resulting from handling beyond that necessary to establish their nature, characteristics and functioning. The Supplier may deduct this diminished value from the refund due.

10.9 Effects of withdrawal. Withdrawal terminates the parties’ obligations to perform the agreement. If the goods are not returned within the specified time limit, the Supplier may take any necessary actions to recover them.

10.10 Exclusions. The right of withdrawal is excluded in the cases provided for under Article 59 of the Consumer Code, including the supply of goods which have been made to measure or clearly personalised.

ART. 11 – LEGAL GUARANTEE OF CONFORMITY

11.1 The statutory guarantee of conformity applies to agreements concluded with the Consumer pursuant to Articles 128 et seq. of the Consumer Code.

11.2 The Supplier is liable towards the Consumer for any lack of conformity existing at the time of delivery of the goods and that occurs within 2 (two) years from the delivery.

11.3 Unless proven otherwise, any lack of conformity that occurs within 1 (one) year from the date of delivery is assumed to have existed on that date, unless this assumption is incompatible with the nature of the goods or with the nature of the defect.

11.4 Any action brought to claim defects that have not been maliciously concealed are subject to a limitation period of 26 (twenty-six) months from the delivery of the goods.

11.5 Consumer goods comply with the agreement if they meet the subjective and objective requirements for conformity set out in Articles 129 and 130 of the Consumer Code.

11.6 In the event of a lack of conformity, the Consumer is entitled:

  • firstly, to bring the product into conformity by means of repair or replacement, at the Consumer’s choice, unless the remedy chosen is impossible or disproportionate compared to the alternative;
  • secondly, where the conditions set out in Article 135-bis of the Consumer Code are met, to a proportional reduction in the price or to termination of the agreement.

The Consumer does not have the right to terminate the agreement if the lack of conformity is minor.

11.7 Notification of lack of conformity. Notification of a lack of conformity may be submitted in writing by email to info@servettocose.com, by Certified email to servetto@pec.it or registered mail to Servetto S.r.l., Via Brughetti n. 32, 20813 Bovisio Masciago (MB), with a description of the defect and indication of the order number or proof of purchase. ART. 12 – LIABILITY FOR PRODUCT DEFECTS
